Ralph Nader is back in the news, but probably not quite in the way he hoped. He hasn’t convinced millions of voters to support his independent campaign for president. His rhetoric against “McBama” hasn’t won him frequent press coverage. But attempting to break a Guinness record for the most speeches in a day will earn you an article or two, just like any other schmo.
Nader traveled across Massachusetts on Saturday, speaking in 21 different locations for more than 10 minutes to more than 10 people. He stopped in cafes and colleges and, of course, a Dunkin’ Donuts. His message? ”Barack Obama has raised more corporate money than any candidate ever before in the history of the Democratic Party,” Nader said. “He has told these business interests he’s their man.”
Obama may be raising more corporate money, but he’s also drawing larger crowds. The day after Nader’s traipse across the Bay State, more than 100,000 people assembled to hear Obama speak in Denver.
Nader believes we need a strong three-party system to have true representation of the electorate. But neither John McCain nor Barack Obama was the conventional-wisdom choice for his party. Obama defeated the Clinton machine during the primaries, and McCain’s campaign was left for dead in the summer of 2007. Voters had plenty of choices during the primaries, and Mitt Romney learned you can’t buy a nomination, no matter how much of your personal fortune you spend.
Yes, we all know our political system is flawed. But sometimes you’ve got to go along with the rules to make your point. Ron Paul, the libertarian congressman from Texas, ostensibly could have run as an independent and not competed in the primaries, but far fewer people would have heard his message. Paul participated in the primary debates and grew legions of fervent fans, despite opposing the two-party system. After bowing out of the Republican race, he had much more influence among independent-party circles.
Ralph Nader has always fought against the system. He got 2,882,955 votes in the 2000 election and, many argue, stuck the country with George W. Bush. In 2004 Nader’s fortunes had changed. He wasn’t even on the ballot in Ohio, the key swing state that year. He only received 463,653 total votes. Will he break 100,000 this year?
Nader is making campaign stops across the country in the final days of the campaign, with many visits at college campuses. Too bad the students will be waiting for Obama instead.

Sure the guy has no chance of winning, but if you’ve ever listened to any of the things he’s said you’d see that he’s by far the smartest of the candidates and saying the stuff that actually needs to be said. And for those that say that it’s Nader’s fault that Bush got elected in 2000, well that’s just dumb, it’s the people who voted for Bush that got Bush elected, blame them.
Don’t get me wrong, I like Obama and the fact that he is inspiring a huge new wave of people, but of lot of it is rhetoric. I guess we’ll see if his talk results in any real change if he gets voted in. I think his foreign policy is a bit iffy, both him and Mccain are on Israel’s jock big time and those guys are doing some real messed up shit over there.
Besides, I think Nader is making a valid point that the American electoral system is a joke and needs to be redone. It’s a two party system and if you don’t happen to like what the two main guys are standing for then you’ve got no other realistic choice, and when you do vote for someone else people like the ones who wrote this article give you shit saying you’re a ’spoiler’.

I’m a little late on writing about this story (via several sources), but it sure is a doozy.
You know how it’s common knowlege that most appeals aren’t successful? Well, if you were a pro-se petitioner in Louisiana for the last 13 years, you knew that you wouldn’t win. Why is that? Because the Chief Judge of their Court of Appeals directed his clerk to summarily deny all appeals from pro-se petitioners without circulating the appeal to other judges.
The clerk, ridden with guilt, committed suicide earlier this year and left a note confessing everything.
This immoral and apparently illegal policy was in place until Jerrold Peterson, the staffer charged with implementing it, blew his brains out in May of last year. Peterson was driven to it in part, his suicide note suggested, by guilt over the nefarious tasks the judges made him perform.
In his note Peterson explained how the court gave indigent appellants the bum’s rush.
Although every criminal writ application is supposed to be reviewed by three judges, he was deputed to winnow out any that had been filed pro se and arrange for their automatic rejection.
Thus were an estimated 2,500 appeals deep-sixed without any judicial consideration whatsoever.
Now, facing public embarassment and possible ethical violations, the Louisiana Supreme Court has stepped in and asked…get this…the same appellate court to look at the appeals again. Note that they did not ask the Court to conduct an investigation into this practice, but simply to consider those appeals that were so summarily denied.
Because, if we placate the defendants with another cursory look at their appeals, we can sweep the ethical violations under the carpet.
At first this whole thing seemed rather odd to me. After all, how is this even possible? Here’s how:
Edward Dufresne, Chief Judge of the Fifth Circuit, took charge of pro se appeals in 1994. He then had Peterson prepare rulings denying writs for all of them and signed off “without so much as a glance,” according to the suicide note. “No judge ever saw the writ application before the ruling was prepared by me,” Peterson wrote in a second suicide note to the Judiciary Commission.
The rulings also bore the names, though not the signatures, of judges Marion Edwards and Wally Rothschild. Neither Edwards nor Rothschild had any clue as to what was in the applications, or even knew that they had been filed, according to Peterson.
So you’ve got one complicit judge and maybe three. But there are 5 more on that court. What of them? Are we to really believe that these 5 (or 7) other judges never once questioned the stark absence of pro-se appeals? Particularly in Louisiana, whose system has the following characteristics:
* About 90 percent of criminal defendants in Louisiana are indigent.
* Louisiana only provides post-conviction legal aid in death penalty cases. Everyone else must either hire a lawyer, find a lawyer to handle their case pro bono, or handle the appeal themselves. Obviously, most have no choice but to opt for the latter.
* One criminal defense lawyer in Louisiana told me that if you’re convicted of murder in Louisiana and you’re innocent, you’re actually better off getting the death penalty. At least then you’ll get a team of lawyers, investigators, and experts to help with your appeal.
This from a state whose criminal justice system was already crumbling. It’s hard to believe that people such as Judge Dufresne take an oath to uphold the law and to prove equal protection under it. Disbarment may be enough, but only barely.
Justice delayed is no justice at all.
